High Court grants summary judgment in the sum of €154,250 against a provider of building services, on the grounds that: (a) there was no term in an earlier settlement agreement that a payment schedule agreed was contingent on the plaintiff retaining the defendant to provide other building services; and (b) it was in the public interest that the settlement of proceedings be given effect to, without attempting to re-open the earlier dispute.
Application for summary judgment - earlier settlement agreement - failure to comply with agreed payment schedule - whether payment schedule contingent on retention of defendant to provide building services - payments to be funded out of fees earned - 2019 settlement agreement - 'entire agreement' clause - legal advice obtained prior to agreement - debt of €279,250.
