High Court refuses judicial review of a decision by An Bord Pleanala to grant planning permission for the construction of an extension to a dwelling house, on the grounds that: (a) the merits of the Board's decision could not be challenged by way of judicial review where there was material on which the Board could make that decision; and (b) the applicant was not entitled to give expert evidence himself concerning the impact of the development on his 'passive solar' house, as he was not an independent expert.
