"Circuit Court judges to appear in nude charity calendar

Minister for Justice v. Judges of the Circuit Court [2013] IESC 999 (Supreme Court, Hefner J, 1 April 2013)
Supreme Court allows appeal from High Court, and discharges injunction restraining Circuit Court judges from appearing naked in charity calendar.
Injunction - judiciary - application for injunction to restrain publication of calendar - proposal that some members of the Circuit Court bench appear in calendar to raise money for worthy causes - proposal that judges be naked or partially naked - suggestion that private parts be discretely obscured by gown, wig, scroll or book - injunction granted by High Court (Whitehouse J) - application moved by Minister for Justice - locus standi - whether Minister had sufficient interest in preventing controversial publication - separation of powers - whether members of the judiciary were employees of Department of Justice or had independent statutory existence - employment law issues - public interest in upholding good name of judiciary - right of Circuit Court judges to ownership of image rights - right to engage in lawful extra-mural activities - relevance of the fact that the calendar was to be sold for charity rather than for profit - relevance of submission that some judges might be more presentable in such a calendar than others - impertinent suggestion from senior counsel that judges of the Supreme Court might similarly disrobe for charity - contempt of court - time-wasting - penalty as to costs.
Quotation from judgment:
"I am in full agreement with the Minister’s view, as expressed on affidavit, that the proposal is “preposterous”. I would go further, and adopt the well-worn phrase "grotesque, unbelievable, bizarre and unprecedented". My brother and sister judges on this court have the same opinion. It will probably compromise the authority of the judges in their own courtrooms, and could make the Irish judiciary a laughing stock abroad if these images were distributed online. But this, unfortunately, is not the point. The Minister has not opened any constitutional or statutory authority that entitles this court to prevent a judge making a spectacle of himself or herself. He has fallen back on the submission that the High Court has full original jurisdiction to regulate the administration of justice in Ireland. Restraining judges from – literally – exposing themselves to ridicule does not fall within that jurisdiction, so we must, reluctantly, allow the appeal from that Court and discharge the injunction."

The University of Limerick law school has launched a web site entitled "Miscarriages of Justice An Irish Perspective".
The site outlines the law on what constitutes a miscarriage of justice, and reviews a number of relevant Irish cases, including: DPP v. Wall; the Nicky Kelly case; and the Kerry Babies case.
