Court of Appeal dismisses appeal against severity of consecutive sentences for three counts of burglary, on the grounds that: (a) cumulatively, the circumstances of the offences were sufficiently egregious as to justify the trial judge’s decision to resort to imposing a consecutive sentence upon a consecutive sentence, and there was no error of principle; and (b) the discount given on the overall sentence for mitigating factors was within the trial judge's legitimate margin of appreciation.
Offence: three counts of burglary
Original sentence: total of 8 years with one year suspended, made up of consecutive sentences for the three counts (with a separate sentence for a drugs offence to be served concurrently)
Appeal by: defence
Outcome: appeal dismissed
