High Court refuses judicial review of the decision of the Minister for Justice's decision to deport a Brazilian family, on the grounds that there was no illegality in the Minister for Justice's decision.
Judicial review - asylum and immigration - Brazilian family challenging the Minister for Justice's decision to order their deportation - illegally present in the State - made representations seeking regularisation of their status in the State - representations unsuccessful - deportation orders made - close relationship between the children and maternal grandparents and uncles who are lawfully resident in the State - alleged entitlement pursuant to the McMahon report - no obligation on the Minister to set out criteria for deportation - criteria set out in the McMahon report - Minister has a wide discretion at deportation order stage - not protection applicants - alleged breach of art. 8 of the ECHR - Minister clearly considered this issue - the consideration of the art. 8 issue is thorough and certainly well within the discretion afforded to the Minister - no illegality in decision to deport the Brazilian family - judicial review refused.
