Northern Irish Court of Appeal allows appeal from decision of High Court, and holds that representations from Department of Education did not give rise to a legitimate expectation that a new school building would be funded.
Judicial review - refusal of Department of Education to fund new school building - finding by department that school was not compliant with "sustainable schools policy" - legitimate expectation - rejection of economic feasibility study - alternative sites for school - appeal from High Court (McCloskey J) - content of school's expectation - whether expectation founded on unambiguous representation - whether expectation fulfilled - whether failure to fulfill legally sustainable - uncertainty in law of legitimate expectation - whether any binding enforceable promise to fund a newly built school on the existing site - whether department acted unreasonably or irrationally in rejection of study.
