High Court grants application dismissing plaintiffs' negligence claims, on the grounds that no prima facie case had been established, and the jury could not reasonably give a verdict for the plaintiffs in respect of any of the causes of action advanced.
Practice and procedure – application for a non-suit – whether the Plaintiffs have made out a prima facie case in respect of each of the causes of action which were pursued at trial – s. 94 of the Courts of Justice Act, 1924 – prima facie case not having been made out – proceedings withdrawn from jury – application granted.
