Court of Appeal partially allows an appeal of an Order of discovery, finding that discovery in respect of one category is necessary and relevant to a Statute of Limitations defence and is required for the disposal of the proceedings.
Appeal of an order from the High Court where category of discovery was refused – Discovery proceedings – appeal against order of discovery - discovery sought in relation to a number of issues – appeal against discovery granted to the Respondent - not established a valid basis whereby this court could interfere with the order for discovery made by the trial judge on foot of the Respondent’s motion filed on the 22 July 2019 – appeal against decision regarding category 3 refused to the appellants - I am satisfied that Saltan has demonstrated that the said documentation is necessary for the fair disposition of the proceedings – appeal partially allowed.
