High Court grants application for security for costs in the amount of €1,790,500.00, as against a limited company which was in charge of a private hospital project, on the basis that there is a bona fide defence, and where there were no special circumstances established which would tilt the balance of justice against the making of an order.
Company law - security for costs - by defendant - reliefs under s.52 Companies Act 2014 - costs from this point onwards estimated at €1,790,500.00 - second plaintiff stated it would not be able to cover costs - court notes plaintiffs failed to establish special circumstances - which would justify the refusal of an order for security - plaintiffs did take issue with the estimate of the costs of defending the proceedings up to trial - court considers delay - no significant prejudice - plaintiffs did not contest contention bona fide defence - court finds plaintiffs have not established any special circumstance which would tilt the balance of justice against an order for security for costs - court makes order for security for costs.
