High Court orders the surrender of the respondent to Northern Ireland to be prosecuted for alleged fraud-type offences, on the grounds, inter alia, that there is correspondence between the two offences set out in the warrant and offences in this jurisdiction; and there is ample evidence to support the issuing judicial authority’s assertion that the offences occurred in the issuing state.
High Court - extradition - European Arrest Warrant - order for surrender of the respondent to Northern Ireland - fraud type offences - whether surrender is prohibited inter alia by sections 38 and 44 of the European Arrest Warrant Act, 2003 - submitted that the offences do not meet the statutory test for correspondence as ordained by the Act - submitted that the offences are alleged to have occurred in this State, and afortiori, outside the issuing state, such that they fall foul of the Section 44 reciprocity test - no reasons made out to preclude the surrender of the respondent - order for surrender made pursuant to section 16 of the EAW Act 2003.
