Supreme Court refuses to set aside its earlier judgment, dismissing an appeal from the Court of Appeal and determining that the appellant serve the balance of his sentence for contempt of court, on the grounds that, if there were any errors of fact in the original judgment, they were not of such an exceptional nature that the judgment of the court should be interfered with.
Relief sought in proceedings: Inquiry into lawfulness of detention; release from detention.
Application before the court: To set aside decision of Supreme Court dismissing appeal from Court of Appeal.
Outcome: Refusal to set aside decision.
Grounds: If there were any errors of fact in the judgment, they did not give rise to a basis to the order that he serve the remainder of his sentence for contempt.
Judgment of the court: Application to set aside an order of the Supreme Court - exceptional jurisdiction to set aside judgments - errors of fact in a judgment - whether appellant accepted that he had been in error.
Note: This is intended to be a fair and accurate report of a decision made public by a court of law. Any errors should be notified to the editor and will be dealt with accordingly.
