High Court dismisses a preliminary objection to an appeal by a creditor of an order of a Personal Insolvency Arrangement (PIA), on the grounds that the appeal against the PIA is not moot, and directs that the appeal proceed to hearing in the ordinary way.
Circuit Court appeals – personal insolvency – application under section 115A(9) of the Personal Insolvency Acts 2012 to 2015 – objecting creditor’s appeal – against the making of an order by the Circuit Court which approved the coming into effect of a PIA – Personal Insolvency Arrangement – preliminary issue raised that the appeal is moot – mootness – appeal dismissed – dismiss preliminary objection to the appeal – direct that the appeal now proceed to hearing in the ordinary way.
