High Court, in an assessment of damages only, grants an award of damages in the sum of €32,630.27 to a person who suffered injuries to her non-dominant left wrist and hand, including mild nerve injuries, while working part time at a gym.
High Court - personal injuries - plaintiff employee and defendant employer - accident occurred in 2011 - employer now in liquidation - by order of court plaintiff permitted to continue her claim against employer - defendant's defence struck out for failure to comply with s. 14(2) of the Civil Liability and Courts Act 2004 - insurer has refused to indemnify employer - when matter came on for hearing neither the employer nor the insurer were present - assessment of damages - plaintiff slipped on wet floor of workplace (a gym) - plaintiff injured her hand - no fracture - referred to physiotherapy, which she attended twice per month for a year - plaintiff seen by consultants in 2011 and 2014 - nerve injuries present in right hand (carpal tunnel) and left had (minor) - right hand injuries not caused by accident at work - plaintiff says she had to give up work due to injury - plaintiff says she was unable to complete part of her third level course concerning video production - as a result plaintiff has not been able to get work in this area after graduation - court notes that at time injuries to non-dominant left wrist were relatively severe - court awards general damages of €30,000 and special damages of €2,630.27.
