The High Court granted the plaintiff’s application for the payment out of €45,146.69, previously lodged in court by the defendant solicitor on foot of an earlier order, together with accrued interest, to be made on account of costs incurred by the plaintiff subject to the plaintiff’s solicitor undertaking to return any overpayment if costs are later adjudicated at a lower sum. The order was made in light of prolonged and complex litigation around legal costs following the solicitor’s use of a client deposit to discharge fees, and the court considered it appropriate due to the extended delays and various determinations already reached in prior taxation and appellate processes. The court also ordered that the defendant file an Affidavit of Means within three weeks but refused to order the defendant to advance the finalisation of the taxation process, as the plaintiff had not established a sufficient basis for such a direction.
