The High Court has dismissed one module of the judicial review of the planning permission for a data centre and substation development, on the grounds that the failure of the inspector to consider the presence of a single bat roost would not materially affect the outcome of the planning process.The court's decision affirms that the planning permission would not have been different had the single Leisler's Bat roost been considered, as the potential for roosts was already accounted for in the assessment process.
