High Court refuses to depart from the 'ordinary rule' as to costs, and orders that an unsuccessful personal injuries plaintiff pay a successful defendant's costs, on the grounds that: (a) the case was not a complex one with multiple 'events'; and (b) the plaintiff's personal circumstances were not of the gravity which would justify a departure from the ordinary rule.
Costs - personal injuries action already decided - defendant was successful and claims costs should follow the event - plaintiff argues there were multiple events and this was a complex case - plaintiff also argues that his personal circumstances should be taken into account - Court disagrees - not complex - no need to take personal circumstances into account - plaintiff to pay defendant's reasonable costs.
