The High Court awarded the plaintiff €87,505.00 in damages against the defendant following a violent and unprovoked shooting incident between neighbouring farmers, which led the plaintiff to sustain significant psychological injuries after witnessing the attack and being directly threatened. The court found the plaintiff's evidence of lasting anxiety, depression, and social withdrawal to be credible, with medical reports supporting ongoing psychological effects. Aggravated and exemplary damages were also granted due to the reprehensible conduct of the defendant, who, as a successful businessperson, prolonged the plaintiff's suffering through delay and denial tactics. The plaintiff's claim for special damages was fully allowed, and the defendant, not appearing at the costs hearing despite due notice, was ordered to pay all costs.
