The High Court awarded the plaintiff €128,005.80 in damages following a violent and unprovoked shotgun attack by the defendant during a dispute over the plaintiff’s right-of-way to his lands, which resulted in significant physical and psychological injuries. In addition to compensatory damages for physical and psychiatric harm, the court awarded aggravated and exemplary damages due to the oppressiveness of the defendant’s conduct both during and after the incident, and the defendant’s protracted obstruction and lack of engagement throughout the civil proceedings. The court ordered the defendant to pay the plaintiff’s costs, having found that the defendant’s actions aggravated the plaintiff’s suffering and amounted to a flagrant abuse of the court process.
