Court of Appeal dismisses appeal of High Court ruling rejecting the plaintiff’s claim for injuries sustained when he fell out of the window from a window seat in a bedroom of the defendants’ hotel premises, on the grounds that: 1) the trial judge was entitled to conclude on the evidence that the plaintiff knowingly gave false and misleading evidence, in light of the video surveillance evidence capturing the plaintiff's movements and activities on seven separate occasions over the period; 2) the trial judge was obliged to dismiss the claim, since to do so would not perpetrate an injustice; and 3) it was neither unfair nor disproportionate of the judge to dismiss the proceedings.
