Court of Appeal refuses application to extend time to bring an appeal, in circumstances where the appellant had entered a guilty plea, on the grounds that finality and certainty were important objectives in any area of litigation, including on the criminal side, and the interests of justice would not be served by permitting an extension of time to enter an appeal where the appellant's underlying objective was to set aside a plea of guilty.
Application to extend time to bring appeal - appellant had pleaded guilty to fraudulent conversion in 2014 - appellant had legal representation at time of plea - offences in 1998 and 1998 - appellant in Australia from 2002 and in custody there fighting extradition from 2009 to 2013 - medical evidence of severe acute stress reaction - psychiatric evidence of PTSD - whether mental and physical state of appellant was such that it undermined the voluntariness of the guilty plea - whether mental and physical state of appellant hindered his ability to appeal despite having formed the intention.
