The High Court has dismissed an application for various orders arising from the alleged contempt of court by a major retailer of court orders directing it to execute fit-out works for an "anchor unit" as part of a development agreement, where it had used a significantly smaller portion of its leased space than the entire area. The retailer's actions were deemed not to be in contempt because the court found the orders to be ambiguous regarding the extent of the fit-out required. The plaintiff's application for a declaration of contempt was dismissed, with the court emphasising that the orders must be clear and unambiguous to be enforceable through civil contempt procedures.
