High Court (Peart J) refuses Article 40 (habeas corpus) inquiry of Romanian national being held in Castlerea Prison finding his detention is in accordance with the law.
Article 40.4.2 - lawfulness of detention - habeas corpus - Committal Warrant - Section 9 of the Offences Against the State Act, 1939 - charge of failing to disclose information of material assistance to a member of An Garda Siochana - unable to take up bail - remanded in custody for DPP directions - no evidence given to support the application for further remand - inexcusable delay - Section 4B(1) of the Criminal Procedure Act, 1967, as inserted by Section 9 of the Criminal Justice Act, 1999 and as amended by Section 37(b) of the Criminal Procedure Act, 2010 - 42 days for book of evidence to be served - further investigations ongoing - large scale investigation - judicial review appropriate and not Article 40 inquiry.
