Court of Appeal allows appeal against severity of sentence for careless driving causing serious bodily harm, on the grounds that, while the headline sentence of 18 months was appropriate and a custodial sentence was warranted, given the degree of culpability was that of a very careless driver, insufficient allowance had been made for the mitigating factors, despite the careful consideration given by the sentencing judge.
Offences: careless driving causing serious bodily harm and failing to stop a vehicle at the occurrence of an accident
Original sentence: 12 months for careless driving, with concurrent sentence of 4 months for failing to stop
Appeal by: defence
Outcome: appeal allowed and more lenient sentence of 8 months substituted
