Court of Appeal allows appeal against the severity of sentence of two years’ imprisonment imposed for sexual assault and burglary arising from a serious offence committed against a vulnerable woman in her own hotel bedroom, and suspends the final nine months of the sentence, on the grounds that, given the youth of this offender at the time the crimes were committed and the progress made post offending, the sentence should have been structured differently.
Criminal law – sentencing – appeal against the severity of two years’ imprisonment imposed for sexual assault and burglary – serious offence committed against a vulnerable woman in her own hotel bedroom – sentence should have been structured differently, and it would have been appropriate to suspend a modest portion of that sentence – final nine months of sentence suspended – appeal allowed.
