Court of Appeal substitutes more lenient sentence, where appellant had been convicted of sexual assault but had been acquitted or the jury had disagreed in respect of other offences, on the grounds that: (a) the sentence imposed should have been one which left no room for doubt about the fact that the allegations that did not lead to conviction had any influence; and (b) while this may result in a sentence lower than merited by the misconduct, justice must be seen to be done.
