Court of Appeal dismisses appeal by Director of Public Prosecutions of a sentence of four years' imprisonment with one year suspended, which was imposed in respect of the offence of dangerous driving causing death, on the grounds that the sentence imposed falls within the available range and does not constitute an error in principle.
Criminal law – sentencing – undue leniency – application pursuant to s. 2 of the Criminal Justice Act 1993 – whether a sentence of four years' imprisonment with one year suspended which was imposed in respect of the offences of dangerous driving causing death was unduly lenient – whether the headline sentence of four years before consideration of mitigation was too low – whether the sentence imposed falls outside the available range and so constitutes an error in principle – approach decided upon by the sentencing judge was not an impermissible one – application refused – appeal dismissed.
