Court of Appeal allows appeal of unduly lenient sentence of nine years' imprisonment imposed for a "tiger kidnapping" offence, and substitutes a sentence of 15 year's imprisonment, on the grounds that the headline sentence of 15 years before accounting for mitigation was an error in principle.
Criminal law – sentencing – undue leniency – whether a sentence of nine years' imprisonment imposed for a "tiger kidnapping" offence was unduly lenient – s. 2 of the Criminal Justice Act 1993 – criticism of the headline or starting sentence of 15 years, absent any mitigation, is well made – sentence in the range of 22 years imprisonment to life imprisonment would have to be considered – imposed in the Circuit Court was unduly lenient – sentence of 15 year's imprisonment substituted – appeal allowed.
