Court of Appeal allows appeal against the severity of sentence of 21 months' imprisonment imposed for theft related offences arising from the taking of power tools, and suspends the final seven months of that sentence, on the grounds that the divergence between a sentence suspended in its entirety (which was imposed on the appellant's co-accuseds) and one to be served in its entirety was too great.
Criminal law – sentencing – appeal against the severity of 21 months' imprisonment imposed for theft related offences – s. 4 of the Criminal Justice (Theft and Fraud Offences) Act 2001 – s. 15(1) and (5) of the Criminal Justice (Theft and Fraud Offences) Act 2001 – theft of power tools – whether there was a failure to depart from the headline sentence to account for mitigating factors – parity in sentencing of co-accused – divergence between a sentence suspended in its entirety and one to be served in its entirety seems too great – sentence of 21 months with the final 7 months suspended substituted – appeal allowed.
