Court of Appeal dismisses appeal from Circuit Court, and affirms a purportedly unduly lenient sentence of two years' imprisonment with the final year suspended, imposed for sending a decomposing pig’s head by post to a member of An Garda Siochana, on the grounds that there was no manifest error of principle resulting in a sentence that was unduly lenient in the sense of being a clear divergence from the norm.
Criminal law – sentencing – undue leniency – whether a sentence of two years' imprisonment with the final year suspended for sending a certain article by post was unduly lenient – section 2 of the Criminal Justice Act 1993 – s. 55(1)(b) of the Communication Regulations (Postal Services) Act, 2011 – decomposing pig’s head sent to garda – whether sentence imposed represents a substantial departure from the norm – no manifest error of principle resulting in a sentence that was unduly lenient in the sense of being a clear divergence from the norm – sentence imposed was not unduly lenient – appeal dismissed.
