Court of Appeal quashes entirely suspended sentences for assault causing harm and production of a knife, and imposes new custodial sentences, on the grounds that the sentences were unduly lenient where there were no wholly exceptional circumstances in the case and a custodial sentence was mandated by the facts.
Offences: assault causing harm contrary to s. 3 of the Non Fatal Offences Against The Person Act 1997 and production of an article capable of inflicting serious injury contrary to s. 11 of the Firearms and Offensive Weapons Act 1990
Original sentence: for each offence two years’ imprisonment suspended in its entirety for four years, both sentences to run concurrently
Appeal by: prosecution (statutory application)
Outcome: sentences quashed and replaced by two sentences of two years, to run concurrently
