The High Court heard applications on costs on several matters and (a) ordered that costs should follow the event in mootness hearings (b) made no order as to costs regarding the first applicants judicial review as the matter was justiciable but did not proceed to trial (c) made no order as to costs regarding the second applicants judicial review as the matter was justiciable but did not proceed to trial (d) made no order as to costs regarding the third applicants judicial review as the respondent could have been correct to recuse herself and (e) granted the Respondent costs against the fourth applicant as the proceedings were vexatious
Application regarding costs – six matters – hearing on mootness – separate judicial review proceedings involving each of the applicant parties – cots of costs application - costs follow the event in hearing on mootness – no order regarding first applicant’s judicial review as there was a justiciable issue but that the issue did not proceed to trial - no order regarding second applicant’s judicial review as there was a justiciable issue but that the issue did not proceed to trial - no order regarding third applicant’s judicial review as trial judge could have taken the view that the respondent was entitled to recuse herself - Respondent entitled to costs against fourth applicant as those proceedings were bound to fail – parties to make submissions on cost of costs application
