High Court, in an appeal against an interlocutory injunction, orders that the plaintiff /respondent company is entitled to possession of an apartment from the appellant, who occupied the apartment by agreement before a receiver took possession, and makes an order restraining further trespass on the property, on the grounds that there was no valid tenancy agreement in place and the property was unlawfully entered into without the consent of the mortgagor.
Appeal against interlocutory injunctions – possession of property – appeal from the Circuit Court - occupied and ownership – trespassing – right of occupancy – appeal dismissed.
