Court of Appeal dismisses appeal from the High Court of a decision of the Office of the Ombudsman upholding a revocation of the appellant's legal aid by the Legal Aid Board, on the grounds that: the appellant had failed to establish a prima facie case that he was in any way discriminated against by the Ombudsman in the manner in which he and his officials received, considered and adjudicated upon his complaint; and the decision of the Ombudsman was a reasoned one, and there is no reason to believe that the decision would have been any different regardless as to the identity, race or ethnicity of the complainant.
Court of Appeal – appeal of substantive judgment and second judgment on costs – substantive judgment in relation to an appeal of a decision of the Circuit Court – appeal to High Court was on a point of law only – the appellant's legal aid was revoked in 2015, the decision of which was upheld on review by the Ombudsman – Complaint under the Equal Status Acts 2000 – 2015 – evidence falls considerably short of a prima facie case of racial discrimination – appeal dismissed.
