High Court grants judicial review of a decision by An Bord Pleanala to grant planning permission for a 'strategic housing development' of 131 build-to-rent apartments, on the grounds that: (a) the proposed development was in material contravention of the relevant development plan as to the provision of communal open space, and the Board had not invoked its powers under the Act to depart from the development plan in that regard; and (b) the Board had not exercised its discretion to bespeak from the public transport provider or the developer written confirmation as to the adequacy of public transport to serve the proposed development at peak hours.
