High Court orders committal of first named Defendant, and that three other individuals be detained indefinitely for contempt of court until such time as they purge their contempt, on the grounds that: the continuing trespass to a property displayed deliberate disobedience of a court order; the Defendant and others were fully aware of the court order and its implications; remaining in the property was a deliberate breach of the said order; and they refused to cease and desist from engaging in conduct in contempt of court.
Application for attachment and committal, ex tempore judgment – order 44 of the Rules of the Superior Courts for the attachment and committal of first named defendant and three other individuals – failure to comply with order of the High Court – Order for possession of the property executed and possession delivered to the plaintiff – non-compliance with High Court order - deliberate disobedience of a court order beyond a reasonable doubt - This conduct amounts to a flagrant and deliberate breach of the order of 3rd March, 2022 by trespassing upon and entering the property, or in the alternative, by declining to undertake to the court not to re-enter the property - make an order of committal of all three individuals until such time as they purged their contempt.
