High Court, in supplemental judgment, grants an "order over" in respect of costs incurred by a former judge in suing the Bar Council of Ireland (BCI), where he had succeeded against the state but not the BCI, on the grounds that the costs had arisen in the same cause of action and that it was reasonable for him to have joined the BCI as its code of conduct was central to the determination of the issues.
Costs of proceedings - claim by former judge for entitlement to act as a barrister and join legal aid scheme - s.78 of the Courts of Justice Act 1936 - "order over" - claim against one defendant for costs incurred in bringing action against other defendant - whether claim arose from the same cause of action - whether it was reasonable to join both parties (i.e. the Bar Council and the state defendants).
