High Court issues rulings on several matters arising from a previous judgement, in particular: (a) granting declarations sought by defendants with regard to the lawfulness of loan facilities and the right to appoint a receiver; (b) reducing the amount granted in counterclaim; (c) granting costs to the defendant, as they follow the event; and (d) refusing to stay the costs order where no reasonable reason for such was raised by the plaintiff and where the plaintiff has a history of failing to comply directions in previous modules in these proceedings.
Ruling on issues arising from previous judgement in Module Three of these proceedings – declarations sought by defendants regarding lawfulness of loan facilities and right to appoint receiver granted – amount granted in counterclaim reduced to better reflect obligations of the loan facility owed by Breccia – defendants entitled to costs as no special circumstances warrant departure from usual rule – plaintiff wishes to appeal previous judgement – is also filed as bankrupt in the US – asks costs be stayed – defendant claims no grounds of appeal have been raised and there is no realistic prospect of overturning – plaintiff has a failure to comply with directions made by the Court in the previous Modules of the proceedings – request for costs to be stayed refused.
