High Court orders the surrender of man to UK to face prosecution for murder and aiding and abetting the causing of an explosion, on the grounds that: it was not established that the UK’s impending departure from the EU would deprive him of his fundamental rights; he would not be deprived of his right to a fair trial; he has not established that particular evidence (whether taken lawfully or unlawfully) has any relevance to the trial for the offences; and there was no abuse of process.
European arrest warrant – prosecutorial warrant – authorities in the United Kingdom seeking his surrender - two alleged offences of murder and an alleged offence of aiding and abetting the causing of an explosion likely to endanger life – car bomb explosion killed two and injured many - delay and disproportionate effect on his personal life – letter of assurance – Brexit point - has not placed any evidence before this Court or even identified any right protected by the EU Charter of Fundamental Rights (“EU Charter”) or the 2002 Framework Decision of which he is at risk of being deprived in the event of Brexit – delay – right to fair trial – alleged breach of constitutional rights – family rights – abuse of process – no intentional misleading of him with respect to the letter of assurance - surrender ordered.
