Court of Appeal allows appeal of unduly lenient suspended sentences imposed for the forging of insurance claims, on the grounds that a custodial sentence of eight months is warranted due to the serious nature of the offences.
Criminal law – sentencing – undue leniency – whether sentences imposed for forging of insurance claims were unduly lenient – s. 2 of the Criminal Justice Act 1993 – appeal against the leniency of wholly suspended sentences – making a false instrument contrary to s. 25 of the Criminal Justice (Theft and Fraud Offences) Act 2001 – using a false instrument contrary to s. 26 of the Criminal Justice (Theft and Fraud Offences) Act 2001 – s. 4 of the Criminal Justice (Theft and Fraud Offences) Act 2001 – attempted theft contrary to common law – sentences were unduly lenient – custodial sentence of eight months imposed – appeal allowed.
