The High Court dismissed an appeal by a tenant from a Residential Tenancies Board (RTB) determination order, which upheld a landlord's notice of termination and found the tenant in arrears. The tenant had unilaterally reduced his rent payments, claiming an implied agreement with the landlord over the non-provision of certain services. The Tribunal found no express agreement to reduce service charges and determined the tenant had no grounds to unilaterally reduce or withhold rent. The original decision by the RTB to validate the notice of termination and order the tenant to pay outstanding rent arrears was affirmed.
