High Court dismisses personal injuries claim brought by a supermarket worker who fell off a step-ladder while stocking shelves, finding that in light of the expert evidence and CCTV footage, the plaintiff's testimony concerning how the accident happened was fundamentally undermined.
Personal injuries – plaintiff fell off a step-ladder in one of the aisles in the off-licence area in Dunnes Stores while stocking shelves – negligence – s. 38(1)(b) of the Courts of Justice Act 1936 – training in the use of step-ladders – inspection of equipment – was there a material defect in the step-ladder – proximate cause of the accident was that Ms Falsey missed a step while descending the ladder – claim against Dunnes Stores dismissed.
