High Court refuses application to restrain the continuation of an unauthorised development on boglands, on the grounds, inter alia, that the development is one which consists of normal winterisation measures at a minor scale, and to cease same would create a risk of environmental damage.
An Bord Pleanála - planning and development - Planning and Development Act 2000 - s.160 - application to restrain continuation of unauthorised development - Closure Bog - applicant contends that unauthorised peat development is causing environmental damage - respondent contends that only normal winterisation measures and maintenance works are taking place - further contends that cessation of those works would cause environmental damage - unauthorised development is at minor scale - normal winterisation measures - cessation of works will create risk of environmental damage - applicant does not dispute or address claim adequately - relief refused with liberty to apply
