Supreme Court dismisses appeal from Court of Appeal, and affirms murder conviction, where the accused had told a number of lies to Gardaí concerning how the deceased died, and how an alleged argument had developed prior to his killing her, on the grounds that the trial judge had given directions to the jury as to how they should consider the lies of the accused, and that such directions did not undermine the proposed defence of provocation.
MacMenamin J (nem diss): Law of homicide - partial defence of provocation - lies told by accused immediately after killing - how trial judge should deal with such lies in charge to jury - fictitious account given by accused to Gardai - allegation that deceased had been attacked by other parties - eventual admission that accused had killed her - account that deceased had started fight irreconcilable with nature of injuries - delay in seeking help - nature of 'Lucas warning'.
