High Court removes a trustee involved with a football club where there was a dispute relating to the maintenance of the sports ground and the potential right to sell the stadium, on the grounds that the defendant trustee company must hand over the keys to the plaintiff, and the defendant trustee company must not take any step in relation to the subject land without the consent of the plaintiff since the defendant trustee company had acted against the interests of the beneficiaries and committed a breach of trust.
Trust law – removal of trustees – whether the plaintiff had authority to bring the proceedings – application to dismiss due to failure of the plaintiff to disclose the identities of the members or because not all members have consented or because of a lack of a representative order – Andrew’s English Civil Procedure (Oxford University Press, 2003) – Zuckerman on Civil Procedure: Principles of Practice (Sweet & Maxwell, 2013) – application to dismiss because of a “pattern of vexatious proceedings” – defendant's status as a trustee – Biehler on Equity and the Law of Trusts in Ireland (Round Hall, 2016) – indemnity issue – s. 25 of the Trustee Act 1893 and/or s. 22 of the Land Law and Conveyancing Reform Act 2009 – defendant removed as trustee.
