Court of Appeal dismisses appeal of allegedly unduly lenient overall sentence of five years' imprisonment imposed for assault causing harm by a father on his two daughters, and threatening behaviour with a firearm, on the grounds that the sentence imposed, while undoubtedly lenient, is within the margin of appreciation afforded to a sentencing judge.
Criminal law – sentencing – undue leniency – whether an overall sentence of five years imprisonmentimposed for assault causing harm by a father on his two daughters and threatening behaviour with a firearm was unduly lenient – Firearms and Offensive Weapons Act – section 2 of the Criminal Justice Act 1993 – whether this was a proper case for a consecutive sentence – whether the circumstances of the threat to kill ought to have attracted a higher sentence – sentence imposed while undoubtedly lenient is within the margin of appreciation that we are required to afford a sentencing judge – appeal dismissed
