High Court, in a telescoped hearing which dealt only with whether or not a psychological report prepared in July 2019 should be updated for a hearing (concerning alleged child abduction) that has been delayed, holds that an updated report should be prepared for the court, with the court also analysing case law in this area and ascertaining that the mother's recent pregnancy should be addressed with the child.
High Court order made on 1st July 2019 pursuant to Article 11(2) of the Brussels II Regulation directing that the child be interviewed by a clinical psychologist and a report prepared for the court - report prepared by 22nd July 2019 - envisaged that the proceedings would be heard by the end of September 2019 - hearing commenced on 13th December 2019 and resumed on 24th January 2020 - this judgement relates to whether an updated report should be sought from the court-appointed psychologist - child's mother brought child here from Poland on 8 December 2018 - Central Authority of Ireland received request dated 29 May 2019 - legal opinion obtained by the parties from Poland which stated that the question of the child's jurisdiction was still to be determined - mother is now pregnant - further report ordered and copy of this judgement to be given to psychologist.
