Stay on prosecution of indecent assault charges pending disclosure of information in relation to previous allegations of sexual assault complaints

Judicial review – indecent assault charges – Circuit Criminal Court – disclosure of unredacted versions of statements in the Book of Evidence – order of prohibition prohibiting further prosecution of the applicant – a stay preventing the further prosecution of the pending charges – failure to make proper disclosure and delay – trial prohibited until such time as it is agreed to provide the requested information - information required to properly prepare a defence – complainant alleged prior incidents of sexual assault – information sought for the purposes of cross-examining the complainant with a view to testing her credibility – previous complaints in the context of the collateral questions rule – applicant is entitled to the disclosure of the information sought – not appropriate to grant a final order prohibiting the trial – Court grants an order staying the prosecution of the charges against the applicant unless the complainant discloses the information sought – information to be disclosed within four months – failure to do so will result in the stay on the prosecution becoming permanent.
