High Court refuses a discovery motion and motion seeking the digital audio recording, but directs a solicitor to submit a further affidavit in an interlocutory hearing regarding the costs of separation proceedings, on the grounds that it was most unusual that a wife in separation proceedings would pay €436,000 in excess of the €200,000 she was ordered to pay in fees by the Taxing Master.
Interlocutory hearing - number of issues raised which were of concern to the Court - incurring by the wife in these matrimonial proceedings (Mrs. M) of fees of €635,000 for a judicial separation, which was granted by MacMenamin J. on the 29th July, 2010 - €436,000 extra appears to have been paid by the wife to her lawyers - wife is seeking financial provision from husband - duty of a court is to ensure that the resources allocated to either spouse are protected from mismanagement - motion seeking discovery of documents relating to legal fees - Taxing Master has found that approximately €508,000 worth of legal fees were correctly charged - wife not seeking reduction in costs at taxation ordered for her benefit - solicitor for mother ordered to swear affidavit dealing with (a) the amount of fees paid since the High Court order of July 2011, (b) what funds are in the solicitors client account belonging to Mrs M, and (c) conversations between wife and legal advisors for two month period in 2012 - order for discovery refused - motion seeking digital audio recording refused.
