High Court grants application to strike out claim of medical negligence and breach of contract arising from breast reduction performed in Poland on Irish patient, on the grounds that: (a) the Irish courts did not have jurisdiction to deal with the claim since there was no evidence that the Polish clinic had directed its activities in any specific way to the Irish market; and (b) it was highly questionable whether there was a viable claim in contract law such as would have enabled the relevant European law regarding choice of jurisdiction to have been invoked.
