High Court grants order for the return of a child to Latvia, from where she had been removed by her mother, on the grounds that: (a) the views of the child were difficult to properly ascertain, where she had clearly been instructed by her mother and sister as to what to say in interview; and (b) the mother had not discharged the burden of establishing that the father had consented to the removal of the child.
Child abduction - consent - views of child - application by father of return of daughter to Latvia - whether he had consented to her removal - procedure for exchange of submissions - cross-examination of deponent - application for adjournment - onus of proving consent.
